Superior Court was held earlier this month in Ashe County. Notable cases include:

Joseph A. Boccardy of Creston charged in 2010 with maintaining a vehicle and dwelling place for keeping and selling marijuana, manufacturing marijuana, processing with intent to sell and deliver marijuana, and felony possession, and possession of a firearm by a felon.

Boccardy was convicted of attempted trafficking of marijuana and possession of a firearm by a felon, and given sentences of 14-17 months for the attempted trafficking charge, and 8-10 months for the possession of firearm by a felon. Both sentences were suspended, and Boccardy received 36 months supervised probation.

Ray Dean Combs of West Jefferson arrested in May 2010 and charged with five counts of first degree rape of a child under the age of 13, and three counts of sexual offense.

Combs’ case was continued until March 12.

Other cases include:

Gilbert Tony Bare - Charged with three counts of trafficking, opium or heroin, conspiracy to traffic in drugs, maintaining veh/dwell/place cs.

Bare pled guilty and received 101-131 months in the Department of Corrections.

Linda Benson - Charged with five counts of trafficking, opium or heroin, and one count of conspiring to traffic opium or heroin.

Benson was convicted on two counts of attempted trafficking, and received 36 months supervised probation.

David Alan Carpenter - Charged with being a habitual felon, habitual impaired driving, and driving with license revoked.

Carpenter was convicted of both counts, and sentenced to 41-50 months in DOC on the habitual felon charge, and given 120 days DOC for the revoked license charge.

Ronny Alan Cherry - Charged with 13 counts of trafficking, opium or heroin, two counts of sell/deliver a schedule three controlled substance, and possession with intent to sell, manufacture and deliver schedule three controlled substance.

Cherry was convicted on three counts of attempted trafficking and given an active sentence of 5-6 months for the pwismd, and sentenced to 36 months supervised probation at the conclusion of the active sentence.

Dakota James Collins - Charged with two counts of sell/deliver a schedule two controlled substance, pwismd schedule two controlled substance, two counts of trafficking opium or heroin, and two counts of conspiring to traffic, opium or heroin.

Collins was convicted on two counts of trafficking opium or heroin and given a 20-33 month suspended sentence with 36 months supervised probation.

Matthew Shane Duncan - Charged with two counts of trafficking, opium or heroin, and one count of conspiring to traffic opium or heroin.

Duncan was convicted on three counts of attempted trafficking and given 36 months supervised probation.

Harold Dean Gilley - Charged with 12 counts of trafficking, opium or heroin.

Gilley was convicted on at least one attempted trafficking charge, and given 36 months supervised probation.

Lindsay Edwin Milam - Charged with H/I felony probation violation, second degree burglary, breaking and or entering, possession of burglary tools, larceny of a firearm, larceny after break/enter, possession of a firearm by felon.

Milam’s probation was revoked and he was sentenced to 17-21 months in DOC for the second degree burglary, and 17-21 months in DOC for the larceny of a firearm charge. The second sentence will run at the conclusion of the first sentence.

Andrew Wade Noblett - Charged with Int child abuse-serious physical injury.

Noblett was convicted of child abuse through reckless disregard and sentenced to 36 months supervised probation.

Michael Lee Reed-Charged with obtaining property by false pretense.

Reed was convicted of obtaining property by false pretense and sentenced to 8-10 months suspended and given 36 months supervised probation.

William Alex Roark - Charged with two counts of indecent liberties with a child.

Roark was convicted on both counts, given a 16-20 month suspended sentence, and received 36 months supervised probation.

Taylor K. Smith - Charged with four counts of trafficking, opium or heroin, and conspiring to traffic, opium/heroin.

Smith was given two 25-39 month suspended sentences, and received 36 months supervised probation.
